Abstract
The rapid advancement of technology has significantly transformed the landscape of criminal investigations in India, enabling law enforcement agencies to enhance their efficiency, accuracy, and effectiveness in solving crimes. Modern tools such as digital forensics, biometric identification, artificial intelligence (AI), and data analytics have revolutionized the process of evidence collection, suspect identification, and crime prevention. The integration of closed circuit television (CCTV) surveillance, cyber forensic techniques, and automated facial recognition systems has further strengthened investigative capabilities.
This Blog examines the legal and procedural dimensions of technology-driven criminal investigations in India, focusing on the frameworks governing the use of digital evidence, surveillance mechanisms, and forensic science. The Indian Evidence Act, 1872, the Information Technology Act, 2000, and various Supreme Court and High Court judgments play a crucial role in determining the admissibility and credibility of electronic evidence in judicial proceedings. Additionally, law enforcement agencies must navigate challenges such as data privacy concerns, cybersecurity threats, and ethical dilemmas arising from technological interventions.
While technology has enhanced the accuracy of investigations, it also presents legal complexities regarding the protection of fundamental rights, particularly the right to privacy under Article 21 of the Indian Constitution. The paper highlights the necessity of continuous reforms in India’s legal framework to ensure a balance between technological advancements and individual rights. Furthermore, it underscores the importance of capacity building, proper training for law enforcement officials, and robust regulatory policies to ensure the ethical and lawful use of technology in criminal investigations. Ultimately, the study advocates for a harmonized approach that leverages innovation while maintaining the principles of justice, fairness, and due process in India’s criminal justice system.
Introduction
The advent of technology has significantly transformed criminal investigations worldwide, including in India, where law enforcement agencies increasingly rely on advanced technological tools to combat crime effectively. The traditional methods of criminal investigation, which primarily depended on eyewitness testimonies, confessions, and circumstantial evidence, have been supplemented—and in many cases replaced—by sophisticated forensic techniques, digital surveillance, and artificial intelligence-based crime detection systems. The integration of technology in criminal investigations has not only improved the accuracy and efficiency of law enforcement but has also introduced new legal and procedural challenges that require careful examination.
In India, the rise in cybercrimes, digital fraud, and technology-enabled offenses has necessitated the adoption of advanced investigative methods. The use of closed-circuit television (CCTV) surveillance, biometric authentication, digital forensics, and big data analytics has significantly enhanced the ability of law enforcement agencies to detect, track, and prevent crimes. Moreover, the role of artificial intelligence (AI), machine learning, and blockchain technology is expanding in areas such as predictive policing, facial recognition, and forensic data analysis. These technologies help law enforcement agencies solve cases more efficiently by providing scientific and data-driven insights that reduce human errors and biases. However, the integration of technology in criminal investigations also raises critical legal and procedural concerns. The collection, preservation, and admissibility of electronic evidence must comply with established legal frameworks, including the Indian Evidence Act, 1872, and the Information Technology Act, 2000. The judiciary plays a crucial role in determining the validity and reliability of digital evidence, ensuring that investigations adhere to due process and constitutional principles. Additionally, concerns related to data privacy, unauthorized surveillance, cyber vulnerabilities, and the potential misuse of technology have become significant legal and ethical challenges. The Supreme Court of India’s landmark judgment in Justice K.S. Puttaswamy v. Union of India (2017), which recognized the right to privacy as a fundamental right under Article 21 of the Constitution, has further underscored the need for a balanced approach in the use of technology for law enforcement.

It will explore the various technological tools used in law enforcement, the existing legal framework governing digital evidence, and the challenges posed by emerging technologies. Additionally, it will assess the need for legal reforms, policy enhancements, and capacity building to ensure a fair and effective criminal justice system. By evaluating both the advantages and limitations of technology in investigations, this study seeks to provide insights into how India can strike a balance between innovation and the protection of individual rights in the pursuit of justice.
