Abstract
This article evaluates the transformative impact of Artificial Intelligence (AI) on legal practice and professional liability. Moving beyond a description of AI’s efficiency gains, the article critically analyses three interlocking challenges: the attribution of legal responsibility when AI systems generate erroneous legal output; the risks of algorithmic bias to fundamental rights guarantees, including Egypt’s constitutional protections; and the fragmentation of regulatory responses across jurisdictions. By juxtaposing the Egyptian legal framework with the European Union AI Act 2024 and the evolving United States approach, the article argues that no single regulatory model is adequate on its own. It concludes that effective governance of AI in legal practice requires a layered framework combining non-delegable professional accountability, enforceable transparency obligations, and adaptive legislative reform grounded in the rule of law.

I. Introduction
The legal profession, historically anchored in precedent, codified rules, and the exercise of professional judgment, is undergoing a transformation that no prior technological development has matched in scope or speed. Artificial Intelligence has moved from a peripheral curiosity to a core operational component of legal practice: predictive analytics, automated contract review, AI-assisted legal research, and generative drafting tools are now standard offerings from major legal technology providers.
Yet the legal system’s adaptation has been uneven and, in many respects, lagging. The introduction of any powerful tool into professional practice raises questions of liability — questions that tort law, professional codes, and procedural rules were not designed to answer for technology that generates outputs autonomously, at scale, and with an opacity that resists conventional audit.
For Egypt, these challenges carry a distinctive character. The Egyptian legal system is rooted in the civil law tradition, with codified obligations enshrined in the Civil Code of 1948 and constitutional rights protected under the Constitution of 2014. The Law on Combating Information Technology Crimes (Law No. 175 of 2018) provides a partial statutory foundation for digital governance, but it was not designed with AI-specific risks in mind.
This article proceeds as follows. Section II examines AI’s integration into legal research and document automation, with critical attention to the risks of AI hallucinations and the shifting role of the lawyer. Section III analyses the liability gap — the legal vacuum that emerges when AI output causes harm — through the lens of Egyptian and comparative law. Section IV addresses algorithmic bias and its threat to constitutional guarantees of equality and fair trial. Section V surveys international regulatory frameworks and their implications for Egypt. Section VI offers conclusions and recommendations.
II. The Integration of AI in Legal Research and Document Automation
A. From Searcher to Verifier: A Fundamental Shift in the Lawyer’s Function
The adoption of AI in legal research has produced what scholars have described as a shift from the lawyer-as-searcher to the lawyer-as-verifier. Where a practitioner once spent hours manually canvassing the Court of Cassation’s archives or reviewing legislative databases, AI-powered platforms can surface relevant precedents, summarise holdings, and flag conflicts within seconds. The efficiency gains are real and substantial. However, the nature of the professional obligation does not diminish: it transforms.
Predictive coding — the use of machine learning to categorise large document sets — and automated due diligence tools have fundamentally altered the economics of legal practice. In litigation contexts, technology-assisted review enables the processing of thousands of documents that would previously have required teams of junior associates. For Egyptian practitioners dealing with the extensive archives of the Court of Cassation, the relevance of such tools is self-evident.
B. The Hallucination Problem and Its Legal Consequences
Yet this efficiency carries a corresponding risk that the legal profession has been slow to acknowledge formally: the phenomenon of AI hallucinations. Large language models, including the generative AI tools now marketed to law firms, produce outputs that are statistically plausible but factually incorrect. They may cite cases that do not exist, attribute holdings to courts that never delivered them, or construct statutory provisions that have no basis in positive law.
The legal consequences of unchecked reliance on such outputs can be severe. A lawyer who submits to a court a written argument citing a non-existent precedent risks disciplinary sanction, adverse costs orders, and reputational damage. More significantly, a client whose legal position is assessed on the basis of fabricated authority may suffer irreparable harm. The bar associations and judicial authorities of most jurisdictions — including Egypt’s — have not yet developed specific guidance on the use of generative AI in court submissions, creating a regulatory lacuna that requires urgent attention.
The response cannot be simply to prohibit AI use. The competitive pressure on firms to adopt these tools is too powerful, and the efficiency benefits — where tools are used responsibly — are too significant to forgo. Instead, the profession requires clear standards for verification: a duty to independently confirm any AI-generated legal citation against authoritative databases before relying upon it in professional work.
III. Professional Liability and the Liability Gap
A. The Attribution Problem in Traditional Tort Law
The central doctrinal challenge posed by AI in legal practice is the attribution of liability. Traditional professional negligence doctrine, as reflected in Egypt’s Civil Code, imposes on the licensed attorney a personal, non-delegable duty of care to the client. Where a lawyer negligently advises a client, the legal analysis is relatively straightforward: the professional breached their duty, the client suffered loss, and causation is established by showing that competent advice would have produced a different outcome.
The introduction of AI into this chain disrupts each element of this analysis. If an AI research tool generates an erroneous legal opinion that the lawyer transmits to the client without adequate verification, is the lawyer negligent? The answer depends on the standard of care that applies to AI-assisted legal practice — a standard that no Egyptian court has yet definitively articulated and that professional guidance documents do not clearly specify.
This is what legal scholars have termed the ‘liability gap’: the absence of clear doctrinal rules for assigning responsibility when AI output causes harm. The gap has multiple dimensions. It encompasses not only the liability of the lawyer who uses the AI, but also that of the technology developer who built it, the deployer who licensed it to the law firm, and the firm itself as an institutional actor.
B. The Egyptian Law Framework: Non-Delegable Duty and Its Limits
Under Articles 163 and 178 of the Egyptian Civil Code, liability in tort is based on fault — either intentional or negligent conduct causing damage to another. The personal nature of professional responsibility means that a lawyer cannot, in principle, transfer their duty of care to a technological tool. Reliance on AI does not extinguish professional accountability; it reframes the question as whether the lawyer exercised reasonable care in using the tool.
The Supreme Court of Cassation has affirmed in multiple contexts that professional liability attaches to the professional who bears the licence, irrespective of the means by which services are delivered. Applied to AI, this principle implies that the ultimate responsibility for AI-assisted legal output rests with the licensed attorney. The AI is, on this analysis, a sophisticated tool rather than an independent agent — and the tool-user bears accountability for the tool’s outputs.
However, this framework, while doctrinely coherent, may produce outcomes that are practically unjust where the AI system’s failure is not detectable by any reasonable professional exercise. If a generative AI tool confidently fabricates a case citation in a form that is indistinguishable from a genuine citation — as has been documented in multiple reported incidents internationally — the fault analysis becomes strained. A rule that imposes strict liability on lawyers for AI failures they could not reasonably detect may deter adoption of beneficial technology without meaningfully improving client protection.
C. Comparative Perspectives: The EU’s Emerging Liability Architecture
The European Union has begun to address this gap legislatively. The EU AI Act 2024 establishes a risk-based classification system under which AI systems used in the administration of justice, legal interpretation, and the application of law are categorised as high-risk systems subject to mandatory conformity assessments, transparency obligations, and human oversight requirements.
Separately, the EU’s proposed AI Liability Directive would introduce a rebuttable presumption of causation in favour of claimants who can demonstrate that a non-compliant AI system was likely to have caused their damage — a significant shift from the traditional requirement of positive proof. This represents an acknowledgement that epistemic asymmetry between AI developers and those harmed by their systems requires modification of conventional liability rules.
Egypt has no equivalent instrument. Its reliance on general tort principles, while providing a baseline, is insufficient to address the distinctive features of AI-caused professional harm. Legislative reform — or at minimum, authoritative guidance from the Egyptian Bar Association — is necessary to fill this vacuum.
IV. Algorithmic Bias, Fundamental Rights, and the Right to Fair Trial
A. The Structural Risk of Bias in AI Legal Systems
Perhaps the most constitutionally significant risk posed by AI in legal practice is algorithmic bias: the tendency of AI systems trained on historical data to replicate and amplify existing patterns of discrimination. This risk is not theoretical. Research across multiple jurisdictions has documented racial, gender, and socioeconomic bias in AI systems used for recidivism prediction, bail assessment, contract risk scoring, and litigation outcome analysis.
In the Egyptian context, the right to a fair trial is guaranteed by Article 96 of the Constitution of 2014, which enshrines the presumption of innocence, and Article 54, which protects personal liberty against arbitrary interference. Where an AI tool used by prosecutors, courts, or lawyers systematically disfavours defendants from particular demographic groups — whether by reason of historical data patterns or training methodology — these constitutional protections are engaged.
B. Attorney-Client Privilege and Data Confidentiality
A second dimension of the ethical challenge concerns confidentiality. When a lawyer uploads sensitive client information to a third-party AI platform to obtain legal research assistance or generate draft documents, the attorney-client privilege — one of the foundational protections of the legal relationship — may be compromised. The client’s confidential communications and case strategy are transmitted to a commercial entity whose data handling practices may not meet the standards required by professional rules.
Law No. 175 of 2018 regulates information technology crimes and provides some protection against unauthorised data access, but it does not specifically address the obligations of legal professionals when using AI tools that process client data. The Egyptian Bar Association’s professional conduct rules similarly pre-date the AI era. The result is an unregulated space in which lawyers may unknowingly expose clients to data risks while believing themselves to be in compliance with their professional obligations.
The EU’s General Data Protection Regulation provides a more robust framework, including specific obligations for automated processing and a right not to be subject to decisions based solely on automated means that produce significant legal effects. Egypt’s data protection law, while evolving, has not yet achieved equivalent precision in its treatment of AI-generated processing of legally privileged data.
V. Comparative Regulatory Frameworks and Lessons for Egypt
A. The European Union: A Risk-Based Comprehensive Model
The EU AI Act 2024 represents the most systematic attempt globally to regulate AI through binding legislation. Its risk-based architecture classifies AI systems into four tiers — prohibited, high-risk, limited-risk, and minimal-risk — with obligations calibrated accordingly. For legal practice, the most significant provisions are those applicable to high-risk systems, which include AI deployed in the administration of justice and legal interpretation. Such systems must undergo conformity assessment, maintain detailed technical documentation, ensure human oversight, and register in a publicly accessible EU database.
The Act also introduces specific obligations for general-purpose AI models — the category that encompasses the large language models increasingly used in legal research and drafting — including transparency requirements and, for models posing systemic risk, mandatory adversarial testing and incident reporting.
The EU model has attracted both admiration and criticism. Its proponents argue that only a comprehensive horizontal framework can address the cross-sectoral risks of AI and prevent the regulatory arbitrage that would result from sector-specific rules. Its critics contend that the compliance burden may disproportionately disadvantage smaller firms and that the pace of technological change will outstrip any legislative framework.
B. The United States: Sectoral Flexibility and Its Limits
The United States has pursued a markedly different approach: reliance on existing sectoral regulators, voluntary commitments from AI developers, and executive guidance. Executive Order 14179, issued in January 2025, prioritised the acceleration of AI development and directed agencies to remove barriers to AI adoption, while preserving space for security and liability considerations.
This approach reflects a characteristically American preference for market-driven innovation over prescriptive regulation. However, the absence of a binding federal AI statute has produced inconsistency, with some states enacting targeted legislation while the federal framework remains fragmented. Legal practitioners operating across state lines face compliance complexity without the clarity that a unified standard would provide.
C. Egypt: The Case for Adaptive Legislative Reform
Egypt’s existing legal infrastructure — Law No. 175 of 2018, the Civil Code, the Constitution, and the Bar Association’s professional rules — provides a foundation but not a complete answer. The country has demonstrated institutional capacity for digital legal reform, and its engagement with international technology governance fora is growing.
What Egypt requires is an adaptive legislative framework that: (i) formally classifies AI systems used in legal practice by risk level, drawing on but not slavishly reproducing the EU model (ii) establishes clear standards for professional liability in AI-assisted legal work, including a verification duty and standards for disclosure to clients; (iii) extends professional confidentiality obligations expressly to data processed by AI tools on the lawyer’s behalf; and (iv) mandates human oversight for AI-assisted outputs in proceedings before Egyptian courts. Such a framework would respect the civil law tradition while equipping it for the AI era.
The Baker McKenzie 2026 Legal Trends report and the International AI Safety Report 2026 both identify the integration of AI into daily legal practice as a defining challenge for legal systems in the immediate future, and note that jurisdictions that develop clear governance frameworks early will enjoy competitive and institutional advantages.
Comparative Perspectives:
By examining the EU AI Act 2024, it becomes evident that the Egyptian legislator can adopt a ‘Risk-Based Approach’ to regulate AI in legal services. Unlike the absolute liability often discussed in theory, a tiered regulatory framework would allow for innovation while protecting the integrity of the judicial process. In Egypt, integrating such a model requires an amendment to Law No. 175 of 2018 to include specific provisions for ‘Algorithm Accountability’. This would ensure that legal tech providers are held to a standard of ‘Due Diligence’ before their tools are deployed in sensitive litigation or contract drafting, thereby bridging the gap between technological advancement and traditional civil liability principles.
Practical Recommendations
To safeguard the future of the legal profession in Egypt, it is recommended that the Egyptian Bar Association establishes a ‘Digital Ethics Committee’. This body would be responsible for drafting a code of conduct specifically for the use of Generative AI in legal practice. Furthermore, law schools, such as the Faculty of Law at Fayoum University, should integrate ‘Legal Informatics’ into their curricula. This educational shift will prepare the next generation of lawyers to not only use AI tools but to audit their outputs for errors and biases. Such proactive measures will transform the perceived threat of automation into a strategic advantage, ensuring that the ‘Human-in-the-Loop’ remains the ultimate guardian of justice.
VII. Conclusion
Artificial Intelligence is neither the saviour nor the nemesis of the legal profession. It is a powerful and increasingly indispensable tool that, like al tools, assumes the ethical character of its user and the adequacy of the regulatory environment in which it operates. The foregoing analysis yields four principal conclusions.
First, the efficiency gains of AI in legal research and document automation are real and significant, but they are accompanied by risks — particularly the risk of AI hallucinations — that require a reformulation of professional duty. The lawyer’s obligation does not diminish with AI adoption; it transforms from direct search to critical verification, a function that demands active professional engagement rather than passive reliance.
Second, the liability gap created by AI in legal practice is a genuine doctrinal problem that Egyptian law, in its current state, is not equipped to resolve. The principle of non-delegable professional duty provides a starting point, but it must be supplemented by specific standards governing the use of AI tools, the disclosure obligations owed to clients, and the allocation of responsibility between lawyers, AI developers, and deployers when AI output causes harm.
Third, algorithmic bias poses a direct threat to constitutional rights that no legal system can afford to ignore. The right to a fair trial and the presumption of innocence — enshrined in Egypt’s Constitution — are not compatible with a legal ecosystem in which AI tools systematically disadvantage particular groups of individuals without detection or accountability.
Fourth, comparative analysis reveals that no single regulatory model is universally applicable, but Egypt has much to learn from the EU’s risk-based approach and from the growing international consensus — reflected in the UNESCO Recommendation on AI Ethics and the International AI Safety Report 2026 — that human oversight, transparency, and accountability must be the non-negotiable foundations of AI governance in any domain that affects fundamental rights.
The 21st-century Egyptian lawyer must be, in Susskind’s phrase, an architect of legal processes as much as a deliverer of legal services. Meeting that challenge requires not only technological literacy but a legal framework worthy of the profession’s historic commitment to justice, accuracy, and the rule of law.
