PREVENTING DOWRY DEATHS IN CONTEMPORARY INDIA : A STUDY OFLEGAL REFORMS .

ABSTRACT

In June 2025, the death of Rithanya, a 27 years old young woman from Tamil Nadu, brought public attention to the issue of  dowry deaths in India. She was reportedly subjected to constant mental and physical abuse due to dowry demands after being married for less than 3 months. Before her death, she had sent voice messages to her family detailing her ordeal she was undergoing. The incident sparked public outrage and legal action, exposing serious shortcomings in the protections provided to women facing dowry- related harassment. Dowry death continue to be one of the most disturbing social problems in India, even after decades of legal prohibition and Reforms women are still subjected to cruelty, harassment, and violence by their husband and in-laws over dowry demands, after leading to unnatural death or suicide within few years of marriage use of marriage is a financial transaction and weak social account ability. This article examines the causes of dowry deaths, the constitutional and  legal Framework regulating dowry- related crimes, important court decisions, and the role of Preventive legal reforms. This Rithanya issue had an impact on me, so I decided to write an article about preventing dowry deaths and reforms.

INTRODUCTION

Dowry  deaths continue to be one of the most serious problems in present- day India, showing the deep inequality and domestic violence that many women face after marriage. Even though strict laws  and constitutional  protection exist, many women still suffer cruelty, harassment, and even death because of dowry demands. Recent incidents not only reflect personal tragedy  but also point to the failure of social responsibility and poor enforcement of laws. Dowry  deaths happen when a women  dies because of continuous harassment or is pushed  to suicide due to dowry demands by her husband or in  laws. These deaths show not only a failure of the law but also a deep problem in society. The case of  Rithanya shows that even in  cities and among well -off  families,  pressure related to dowry can still lead to loss of life.

MAJOR PREVENTIVE REFORMS TO PREVENT DOWRY DEATHS

  • STRICT AND PROPER ENFOREMENT OF LAWS

 Dowry laws must be applied seriously,  police should act quickly on complaints, register cases without delay, and ensure fair investigations.

  • SPEEDY INVESTIGATION AND COURT HEARINGS

Dowry – related cases  should be investigated and tried quickly so justice is not delayed and offenders are not encouraged.

  • PUBLIC AWARENESS AND EDUCATION

 People must be aware and  educated that dowry is  illegal and harmful. Awareness programmes in schools and communities can help change mind-set.

  • EARLY PROTECTION AND SUPPORT FOR VICTIMS

 women facing dowry harassment should receive immediate protection, counselling, and safe shelter before the situation becomes dangerous.

  • RESPONSIBILITY OF SOCIETY AND FAMILY

 Families,  neighbours ,and community leaders should step in when they see dowry harassment and support victims  instead of remaining silent.

CONSTITUTIONAL AND STATUTORY LEGAL FRAMEWORK 

  1. CONSTITUTIONAL FRAMEWORKS
  • ARTICLE 14 – Constitution guarantees equality before law and equal protection of laws for women
  • ARTICLE 15 (1)  – Prohibits  discrimination on the grounds of sex,  race, cast, religion, place of birth.
  • ARTICLE 15 (3) – Allow the government to enact special laws for women and children.  It is on this basis that many laws related to women’s safety have been made.
  • ARTICLE 21 – Grants women the  right to live with dignity and security. This  right has been the basis  for court  decisions on  contemporary issues such  as violence against dowry harassment, violation of privacy.
  1. DIRECTIVE PRINCIPLE OF STATE POLICY
  • ARTICLE 39 – Directs the state to frame laws and policies that ensure social and economic justice 
  • ARTICLE 39 ( d) Says that men and women should receive equal pay for equal work. This promotes financial independence of women.which helps reduce their dependency on marriage and dowry.
  • ARTICLE 39 (e) – Directs the state to ensure that the health and strength of women are not abused and the citizens are not forced into exploitation due to economic pressure
  • ARTICLE 39 (f) – It requires the state to protect youth and women from moral and material exploitation and to ensure they live with dignity.
  1. BHARATIYA NYAYA SANHITA,(BNS), 2023
  • SECTION 80 – This section is an important section that directly deals with dowry deaths. This section applies if the woman dies unnaturally within 7(seven) years of marriage as a result of cruelty or harassment by the husband or his relative due to dowry. The punishment of dowry death is minimum seven years, ( 7) to life.
  • SECTION 85 – Harassment of the woman by the husband or her relatives. This section covers physical and mental cruelty. It includes harassment related to dowry demands.
  • SECTION 86 -This section defines “cruelty” as physical or mental harassment of a woman by her husband or his relatives, especially dowry – related harassment. This section explains what amounts to “cruelty” under the law and supports the application of section 85.
  1. BHARATIYA SAKSHAYA ADHINIYAM, (BSA), 2023.
  • SECTION 118 – . If a woman dies unnaturally within seven years (7) of marriage and it is proved that the husband or his relatives had inflicted cruelty on her before her death due to dowry, the court will presume that they caused the death.
  • SECTION 117 – This section allows the court to presume that if a woman commits suicide within seven years (7) of marriage, and it is proven that she was subjected to cruelty by her husband or his relatives, they were the instigators of the suicide.
  • SECTION 61– Electronic or digital records such as videos, CCTV footage , mobile recording , voice messages ,social media posts, message call data admissible as a legal evidence
  1. DOWRY PROHIBITION ACT,1961

This law prohibits the giving, receiving and demanding of dowry. It punishes the demand of dowry and also protects the woman’s right to dowry items. The following are some major sections that directly address dowry.

  • SECTION 2 – Definition of dowry.
  • SECTION 3 – Penalty for giving or taking dowry
  • SECTION 4 – Penalty for demanding dowry
  • SECTION 6 – Dowry to be for the benefit of the wife or her heirs.
  1. PROTECTION OF WOMEN FROM DOMESTIC VIOLENCE ACT, 2005.

This act provides civil remedies such as protection orders, residence rights ,and monetary relief to women facing  dowry- related harassment.

LANDMARK CASE LAW FOR DOWRY HARASSMENT

  • STATE OF UTTAR PRADESH V. AJMAL BEG & ORS. (2025) INSC 1435 ( SUPREME COURT OF INDIA , 15 DECEMBER 2025)

In this case  Nasrin , a young bride, was repeatedly harassed by her husband Ajmal Beg and his in -laws for dowry, including   15,000 and other articles. Within a short period of marriage, due to continuous cruelty, Nasrin was set on fire, resulting in her death. The supreme court restored the conviction of Ajmal Beg and his mother Jamila beg for dowry death. The court held that continuous harassment and cruelty “soon before death” attracted the statutory presumption under Section 80 BNS and the dowry prohibition act, 1961. Minor contradictions in witness testimony did not outweigh the core evidence. The judgement reaffirmed that dowry death is a serious social offence requiring strict judicial scrutiny and both were convicted life imprisonment under BNS section 80  and dowry prohibition act.

RITHANYA V. STATE OF TAMILNADU (2025), TRIPPUR DOWRY. DEATH CASE (2025) PENDING  BEFORE MADRAS HIGH COURT.

In this case Rithanya, a young bride, was repeatedly harassed by her   husband. Kavin Kumar and his family over dowry , including cash and household items. Before her death, she sent distressing voice message to her father describing the mental and physical torture she was facing. Due to persistent cruelty, she committed suicide . Her family filed a case under BNS section 85 (dowry ) and 108 ( abetment of suicide ) and  the dowry prohibition act. This case is currently pending before the madras high court. Conditional bail has been granted to the accused with strict monitoring. The court directed the Trippur superintendent of police to oversee the investigation and ensure all charges are included in the final charge sheet.

CONCLUSION

Dowry death remains a grave social evil in India. Strong laws, swift justice, and societal responsibility are essential to protect women, change mind-sets, and eradicate this persistent injustice. Dowry deaths are not just legal violations but a reflection of deep – rooted social injustice . Combating them requires strict enforcement , judicial vigilance, and a collective societal effort to ensure dignity, safety, and equality for women. Ending this menace, and collective responsibility . as mahatma Gandhi said ,

THE TRUE MEASURE OF ANY SOCIETY CAN BE FOUND IN HOW IT TREATS ITS WOMEN”
